Terms of Service

Welcome to WidePik ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of widepik.com and our services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By creating an account, downloading assets, or using any part of our service, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

WidePik is a digital marketplace that provides stock media assets including PSD files, CDR files, and AI files. All assets are created by WidePik's team of designers and are owned by WidePik. We offer both free and premium assets for download. Premium assets are available through monthly subscription plans.

3. Account Registration and Use

3.1 Account Creation

You may browse and download limited free assets without an account (subject to daily limits). To access additional features and premium content, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Sharing

You may share your account credentials with others at your discretion. However, download limits and restrictions apply to the account regardless of how many users access it. You remain responsible for all activity that occurs under your account, including any violations of these Terms.

3.3 Account Eligibility

You must be at least 13 years old to use our services. By creating an account, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use our services.

4. Download Limits

We enforce the following download limits to ensure fair use and prevent abuse:

• Non-registered users: 3 free assets per day
• Registered users: 5 free assets per day
• Trial subscribers: 1 premium asset per day during 7-day trial period
• Premium subscribers: 20 free assets per day and 10 premium assets per day

These limits are tracked per account or browser identifier and reset daily at midnight UTC. Attempting to circumvent these limits through any means, including but not limited to creating multiple accounts, using VPNs, or clearing browser data, may result in immediate account suspension or termination without refund.

5. Subscription Plans

5.1 Free Trial

We offer a 7-day trial period for new subscribers. During the trial, you can download up to 1 premium asset per day to evaluate the quality and legitimacy of our assets. After the trial period ends, your subscription will automatically convert to a paid monthly subscription at the current subscription rate unless you cancel before the trial ends. You will be notified via email before your trial converts to a paid subscription.

5.2 Billing and Payment

Subscriptions are billed monthly and automatically renew at the end of each billing period unless cancelled. Payment is processed through our third-party payment processors including Stripe, EasyPaisa, and JazzCash. By subscribing, you authorize us to charge your payment method on each renewal date. If payment fails, we will attempt to process payment up to 3 times over 7 days. If payment continues to fail, your subscription will be cancelled and premium access will be revoked.

5.3 Cancellation

You may cancel your subscription at any time through your profile settings. Upon cancellation:

• You will not be charged for subsequent billing periods
• You will retain access to premium features until the end of your current billing period
• You may resume your subscription at any time before the billing period ends
• After the billing period ends, your account will revert to free tier with associated download limits

5.4 Price Changes

We reserve the right to modify subscription pricing at any time. We will notify you via email at least 7 days before any price changes take effect. The new pricing will apply to your next billing cycle after the notification period. Continued use of the service after the price change takes effect constitutes acceptance of the new pricing. You may cancel your subscription before the new pricing takes effect if you do not agree to the price change.

6. Refund Policy

We generally do not offer refunds for subscription fees. All sales are final. However, we may consider refund requests on a case-by-case basis in exceptional circumstances, such as:

• Technical issues preventing you from accessing the service
• Duplicate charges due to payment processing errors
• Unauthorized charges (subject to verification)

To request a refund, contact us at [email protected] or through our Contact Us page within 7 days of the charge. Include your account email, transaction details, and reason for the refund request. Refund decisions are at our sole discretion and are not guaranteed.

7. License and Ownership

7.1 WidePik Ownership

All assets available on WidePik are created by our team of designers and are owned by WidePik. We use only copyright-compliant source materials in creating our assets. If you believe any asset infringes your copyright, please see Section 16 (Copyright and DMCA) for our takedown procedure.

7.2 License Grant

Upon downloading an asset, you are granted a non-exclusive, non-transferable, worldwide license to use the asset according to these Terms. You may use downloaded assets for your personal or commercial projects. This license remains valid even if you later cancel your subscription or your account is terminated, provided the asset was downloaded while your account was in good standing.

7.3 Permitted Uses

You may use downloaded assets for:

• Personal projects and non-commercial use
• Commercial projects including products for sale
• Client work and commissioned projects
• Digital and print media of any kind
• Website design and development
• Social media content and marketing materials
• Advertising and promotional materials
• Incorporation into larger creative works

7.4 Attribution Requirements

Attribution to WidePik is appreciated but not required for any assets, whether free or premium. We operate on an honor system and encourage users to credit WidePik when possible to help others discover our platform.

8. Prohibited Uses

You expressly agree not to:

• Resell, redistribute, sublicense, or share downloaded assets as standalone files with others
• Make assets available for download on other websites, file-sharing platforms, or marketplaces
• Use assets to create competing stock media platforms, marketplaces, or template libraries
• Use assets to create NFTs (Non-Fungible Tokens) or similar blockchain-based products for sale
• Use assets in connection with adult content, pornography, or sexually explicit materials
• Use assets to promote hate speech, discrimination, harassment, violence, or terrorism
• Use assets in defamatory, libelous, or unlawful content
• Use assets to mislead, deceive, or defraud others
• Use assets in connection with illegal activities, drugs, weapons, or controlled substances
• Claim ownership or authorship of the original WidePik assets
• Remove or alter any copyright notices, watermarks, or attribution information from assets
• Use automated tools, bots, scrapers, or scripts to download assets in bulk
• Reverse engineer or decompile assets to extract proprietary techniques or methods
• Circumvent download limits, access controls, or other technical restrictions
• Share account credentials for the purpose of circumventing subscription fees

9. Content Standards and Moderation

All assets on WidePik are curated and uploaded exclusively by our team. We maintain strict content standards and do not allow user-generated uploads. Our content moderation policies prohibit:

• Adult content, nudity, or sexually suggestive materials
• Hate speech or content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Violent, graphic, or disturbing imagery
• Content promoting illegal activities, drugs, weapons, or dangerous substances
• Misleading, deceptive, or fraudulent content
• Content infringing third-party intellectual property rights

We continuously review our asset library to ensure compliance with these standards. If you believe any asset violates these standards, please contact us immediately.

10. Intellectual Property

All content on WidePik, including but not limited to designs, assets, text, graphics, logos, user interface, visual design elements, and software, is the property of WidePik or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws of Pakistan and international treaties. The WidePik name, logo, and all related product and service names are trademarks of WidePik. You may not use these trademarks without our prior written permission. Unauthorized use may violate copyright, trademark, and other laws.

11. Content Modifications and Removal

We reserve the right to modify, update, or remove any assets from our platform at any time without prior notice or liability. Reasons for removal may include but are not limited to copyright concerns, content standard violations, or quality control. Assets you have already downloaded remain available to you according to the license terms at the time of download. We may also update, modify, suspend, or discontinue any feature or functionality of our service at our sole discretion.

12. Service Availability

We strive to maintain high availability for our services. However, we may occasionally perform scheduled or emergency maintenance that results in temporary service interruptions. We are not liable for any downtime, service interruptions, or data loss that may occur. We do not guarantee uninterrupted, error-free, or secure service. Access to our services may be affected by factors beyond our control, including internet connectivity, device compatibility, and third-party service availability.

13. Account Suspension and Termination

13.1 Violations and Termination

We reserve the right to suspend or terminate your account immediately, without prior notice and without refund, if you:

• Violate these Terms of Service or our Privacy Policy
• Engage in fraudulent activity or payment disputes
• Circumvent download limits or access controls
• Share assets in violation of license terms
• Use automated tools or bots to access our service
• Engage in abusive behavior toward our team or other users
• Use our services for illegal purposes
• Repeatedly violate our content standards

13.2 Repeat Infringer Policy

In accordance with copyright law, we maintain a policy of terminating accounts of users who are repeat copyright infringers. If we receive multiple valid copyright infringement notices regarding your account, we will terminate your access to our services.

13.3 Appeals

If your account is suspended or terminated, you may contact us at [email protected] or through the Contact Us page to discuss the matter. Provide your account email, the reason for your appeal, and any relevant information. We will review appeals on a case-by-case basis within 7 business days. Our decisions regarding account termination are final and binding.

13.4 User-Initiated Termination

You may terminate your account at any time by contacting us at [email protected]. Upon account termination:

• Your access to premium features will cease immediately (unless you have remaining paid time)
• Your personal data will be deleted according to our Privacy Policy retention schedule
• You will retain the right to use any assets downloaded prior to termination according to the license terms
• Any active subscription will be cancelled (no refunds for unused time)

14. Disclaimers and Warranties

14.1 Asset Quality

While we strive to provide high-quality assets created by professional designers, we do not guarantee that all assets will meet your specific requirements, be error-free, or be compatible with all software versions. Assets are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. You are responsible for verifying that assets meet your needs before use.

14.2 Service Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, WidePik disclaims all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement of third-party rights
• Warranties that our services will be uninterrupted, secure, or error-free
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that defects will be corrected

15. Limitation of Liability

To the maximum extent permitted by applicable law, WidePik and its owners, officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Loss of goodwill or reputation
• Cost of substitute goods or services
• Business interruption
• Any other intangible losses

These limitations apply whether the claim is based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is less. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

16. Copyright and DMCA

We respect intellectual property rights and expect our users to do the same. All assets on WidePik are created by our team using copyright-compliant source materials. If you believe that any content on our platform infringes your copyright, we encourage you to contact us so we can investigate and take appropriate action.

16.1 Filing a Copyright Complaint

To file a copyright infringement complaint, please provide the following information to [email protected] or through our Contact Us page:

• Your full name, address, telephone number, and email address
• A detailed description of the copyrighted work you claim has been infringed
• The specific URL or location on WidePik where the allegedly infringing material is located
• Proof of copyright ownership (e.g., copyright registration certificate, original files with metadata)
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
• A statement that the information in your notice is accurate
• A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

16.2 Our Response Process

Upon receiving a valid copyright complaint, we will:

• Acknowledge receipt of your complaint within 2 business days
• Investigate the claim thoroughly, which may take 5-10 business days
• Remove or disable access to the allegedly infringing material if we determine the claim is valid
• Notify you of our decision and actions taken

16.3 Counter-Notification

If you believe your content was wrongly removed due to a copyright complaint, you may file a counter-notification by providing the following to [email protected]:

• Your full name, address, telephone number, and email address
• Identification of the material that was removed and its location before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
• A statement that you consent to the jurisdiction of courts in Lahore, Punjab, Pakistan
• Your physical or electronic signature

16.4 False Claims

Submitting false or fraudulent copyright claims may result in legal consequences, including liability for damages, attorney fees, and other costs. We reserve the right to seek damages and legal remedies against parties who submit bad faith copyright complaints.

17. Indemnification

You agree to indemnify, defend, and hold harmless WidePik and its owners, officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from:

• Your use or misuse of our services
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property rights, privacy rights, or publicity rights
• Your violation of any applicable laws or regulations
• Any content you create using our assets that causes harm or infringement
• Any false or misleading information you provide to us

This indemnification obligation will survive termination of your account and these Terms.

18. Dispute Resolution

If you have any concerns, complaints, or disputes regarding our services, please first contact us at [email protected], via phone (number available on our Contact Us page), or through the contact form on our Contact Us page. We are committed to resolving issues fairly and promptly on a case-by-case basis. We will make reasonable efforts to resolve disputes informally within 30 days of receiving your complaint. Most disputes can be resolved through good faith communication.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan and the Province of Punjab, without regard to conflict of law principles. Any disputes, claims, or controversies arising out of or relating to these Terms, our services, or your use thereof shall be subject to the exclusive jurisdiction of the courts located in Lahore, Punjab, Pakistan. You consent to personal jurisdiction in these courts and waive any objection to venue in these courts.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email to the address associated with your account at least 7 days before the changes take effect. Changes will also be posted on this page with an updated "Effective Date." Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using our services and may cancel your account. We recommend reviewing these Terms periodically to stay informed of updates.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that most closely reflects the intent of the original provision and preserves the economic balance of these Terms.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on our services, constitute the entire agreement between you and WidePik regarding the use of our services and supersede any and all prior or contemporaneous agreements, understandings, or representations, whether written or oral. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

23. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms or any rights hereunder without restriction, including to any affiliate or successor in interest. Any attempted assignment in violation of this section shall be void.
